Don’t see your question in the list below or want further clarification? If you live in North Georgia or Arkansas and need the counsel of a personal injury lawyer, contact The Law Offices of Charles Scott for a free, no-obligation consultation.
How Much is My Claim Worth?
Answer: This is the most common question asked by those seeking counsel for personal injury. It is also the most difficult question to answer simply because there are a multitude of variables to consider. Some of the most common are: the nature of the injury, facts of loss, age, sex, health, and the existence of any preexisting conditions.
The attorney that you hire is also a huge driver of a claim’s value. Usually, the value of a claim is a matter of opinion and the skill of the lawyer in persuading the insurance company and/or, ultimately, the jury that their assessment is right. An experienced personal injury attorney can effectively negotiate your case while also countering many of the tactics that insurance companies use against injured parties.
This holds true regardless of the type of personal injury case, be it a wrongful death lawsuit, medical malpractice, car accident, or truck wreck involving a commercial vehicle.
How Do I Pay for Legal Assistance?
Answer: In North Georgia, Metro Atlanta, and Arkansas, attorneys who handle personal injury claims are usually paid on a contingency basis. This means that you do not have to pay anything unless – and until – I win your case. My fees will be deducted from your settlement or award. If there is no recovery, I don’t get paid.
How Long Will It Take to Get a Fair Settlement Offer?
Answer: To even begin negotiations with an insurance company, your personal injury attorney will have to provide all documentation of medical bills, medical records, lost income, mileage, prescription receipts, and so on. For obvious reasons, this can usually only be done upon completing treatment. In the case of a wrongful death, it can sometimes move a little faster, depending on the circumstances. In any event, gathering all of this documentation does take time. In a simple case, I can usually have a demand package ready within 30 – 45 days of the completion of treatment. However, if a settlement cannot be reached and a lawsuit needs to be filed, it can take considerably longer. In North Georgia and Arkansas, personal injury lawsuits can vary in length from weeks to years in some instances. I need to thoroughly investigate your claim to make sure you get all the money you are entitled to.
Will I Have to Go To Court
Answer: Only about 2-3% of personal injury cases actually go to court. If the insurance company agrees to pay what I believe your case is worth, and you wish to settle for that amount, then you don’t have to go to court. If your case is handled properly, a full-blown trial is unlikely. Of course, if the insurance company refuses to pay the acceptable amount, then we get to proceed in court.
What is the Statute of Limitations on Personal Injury Lawsuits in Georgia?
Answer: I often get asked: “How long do I have to file a personal injury lawsuit in North Georgia?” In most cases, you have two years to file a personal injury claim in Georgia. Because of this, it is imperative to contact a North Georgia personal injury attorney as soon as possible.
What is the Statute of Limitation on Personal Injury Lawsuits in Arkansas?
Answer: In Arkansas, you have 3 years to file a personal injury claim. Again, the moment you are involved in a vehicle accident, medical malpractice, or wrongful death situation, contact an Arkansas personal injury attorney like Charles Scott.
